End User License Agreement (EULA) 25 June 2023

This End User License Agreement (hereinafter referred to as the "Agreement") is a legal agreement between you (hereinafter referred to as the "User") and inXsol LLC (hereinafter referred to as "inXsol") regarding the use of the website and its associated services (hereinafter referred to as the "Website").

By accessing or using the Website, the User acknowledges and agrees to be bound by the terms and conditions set forth in this Agreement.

By using the Website, the User confirms that they are over the age of 18. If you are under the age of 18, you must discontinue using the Website immediately.

The term "Your Content" refers to any media files uploaded by you (e.g., audio files), any user accounts created by you, and any survey/evaluation content provided by you. Your Content remains your sole property, and inXsol does not claim ownership or rights over Your Content. For analytics and product improvement, during the term of non-fee based use of this site you permit inXsol to use Your Content to inform platform improvements and public demonstrations of system capability. You can request removal of your content by emailing ryng@inxsol.com.

3. Intellectual Property:

All other functionality, code, and intellectual property used on this Website, including but not limited to designs, logos, trademarks, and software, are the exclusive property of inXsol. The Website and its contents are protected by copyright and other intellectual property laws. All rights reserved.

4. Restrictions on Use:

The User agrees not to:

• Modify, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from or through the Website;
• Use the Website in any manner that violates any applicable laws or regulations;
• Attempt to gain unauthorized access to any portion of the Website, other accounts, computer systems, or networks connected to the Website, through hacking, password mining, or any other means.

5. Limitation of Liability:

In no event shall inXsol be liable for any direct, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of the Website or this Agreement, even if advised of the possibility of such damages.

6. Indemnification:

The User agrees to indemnify and hold inXsol, its affiliates, officers, directors, employees, and agents harmless from and against any claims, liabilities, damages, losses, and expenses, including, but not limited to, reasonable attorneys' fees, arising out of the User's use or misuse of the Website or any violation of this Agreement.

7. Termination:

inXsol reserves the right to terminate or suspend the User's access to the Website at any time and without prior notice, for any reason or no reason, including but not limited to the User's breach of this Agreement.

8. Governing Law:

This Agreement shall be governed by and construed in accordance with the laws of [Your Country/State], without regard to its conflict of laws principles.

9. Entire Agreement:

This Agreement constitutes the entire agreement between the User and inXsol regarding the use of the Website and supersedes any prior or contemporaneous understandings or agreements.
